Participation of the Secretary-General in the 3rd INTERNATIONAL CONFERENCE ON MEDIATION (VIRTUAL) organized by Faculty of Law, University of Delhi & Delhi School of Public Policy and Governance, Institution of Eminence, University of Delhi In association with Mediation and Conciliation Project Committee, Supreme Court of India on 9-10 April 2022.
H.E. Dr. Kamalinne Pinitpuvadol, Secretary General of AALCO was invited to co-chair a session on Cross Border Dispute and International Mediation: In present International Perspective at the 3rd International Conference On Mediation (Virtual) on the 10 April 2022.
Prof. (Dr.) V.K. Ahuja, Hon’ble Vice-Chancellor, NLUJA Assam & Joint Director, Delhi School of Public Policy & Governance, Institution of Eminence, University of Delhi moderated the session. He commenced by giving a brief history on Mediation giving examples from Indian Mythology on how India has a significant knowledge of mediation.
Shri A. J. Jawad, Mediator, partner & Head of ADR Services, KD Lex Chambers was invited as a Special Guest to the session and he discussed about the commercial disputes, he also spoke of the Cross border dispute in Mediation.
Dr. Aniruddha Rajput, Member, United Nations International Law Commission was invited as a Guest of Honour who gave an indepth view about investor State mediation and how one should be careful about the political implications of the disputes. He stressed on the fact that in addition to the text being nice, the culture should also be nice.
The Secretary General spoke about the potential of mediation in cross-border disputes. He also informed that there are member states of AALCO who are party to the Singapore Convention and hopes that other non-members will also join the Singapore Convention. He also highlighted the role and functions of the 6 Arbitration Centers of AALCO in various Members States. He concluded by saying that Cross-border mediation is now a dispute resolution method which is suitable and effective in the matter of international commercial disputes.
Hon’ble Mr. Justice Ajay Bhanot, Judge, Allahabad High Court, the chair of the session spoke about the different aspects of mediation. He highlighted about the importance of creating acceptability of mediation in global aspects. He also insisted on creating a pool of mediators and the necessity of the training of mediators. He concluded by saying that a mediator needs to be a communicator.
Prof. (Dr.) V.K. Ahuja, summarized the session and applauded the discussions during the session. He presented his vote of thanks to each speaker where after the session was concluded.
